Terms of use of the 3D configurator

1. Purpose

These terms of use (“Terms”) govern access to and use of the 3D stand configurator available at monstand.africa (the “Configurator”), published by PIXLEVENT SARL with a share capital of XOF 2,000,000 — RCCM CI-ABJ-03-2021-B12-01853 — NCC 2132709F — Villa 59, Angré 8e Tranche, Cocody, Abidjan, Côte d'Ivoire — BP 385 CIDEX 3 Abidjan — trading as monstand.africa (the “Publisher”). Any use of the Configurator, and in particular the creation of an account by email, constitutes full acceptance of the Terms.

2. Purpose of the service

The Configurator is a decision-support tool made available free of charge to professionals to prepare an exhibition stand project with a view to ordering from the Publisher. The 3D renderings, realistic views, dimensioned plans, indicative quotes and configuration codes it produces (the “Deliverables”) are preparatory to a commercial offer by the Publisher; they have no contractual value until a firm quote has been issued and accepted (see our terms of sale).

3. Intellectual property

The Configurator, its code, interface, 3D library (furniture, structures, materials, textures, design models), pricing algorithms and all Deliverables are the exclusive property of the Publisher and are protected by Ivorian and international intellectual-property law (Law no. 2016-555 on copyright and related rights, revised Bangui Agreement).

The User receives only a personal, non-exclusive, non-transferable and revocable licence to use the Configurator and the Deliverables, limited to preparing and following up a project with the Publisher. No ownership is transferred.

Content supplied by the User (logos, graphics, adhesives, texts) remains the User's property. The User warrants holding the necessary rights and grants the Publisher the right to reproduce them for renderings, quotes and, where applicable, the manufacture of the stand.

4. Prohibited uses

Without the Publisher's prior written consent, it is prohibited to:

Any breach entitles the Publisher to suspend access without notice and to claim, as a penalty clause, a lump-sum indemnity of [TO COMPLETE] % of the indicative quote concerned, with a minimum of [TO COMPLETE] XOF, without prejudice to further damages.

5. Design work and 3D files

Study, modelling and renderings are offered as part of an order placed with the Publisher. A User who wishes to obtain the files (high-definition renderings, dimensioned plans, 3D files) without ordering may acquire them as a design service invoiced at [TO COMPLETE] XOF, deductible from a subsequent order; the licence granted then remains limited to [TO COMPLETE].

6. Account and access codes

Full access to the Configurator requires registration by email (one-time code). Configuration codes and advisor codes are strictly personal. The User is responsible for keeping access confidential and informs the Publisher of any unauthorised use.

7. AI-generated renderings

The “Realistic view” feature produces, from the 3D sketch and a description, a mood image using a third-party service (OpenAI). These images are indicative and non-contractual: they may differ from the configuration (details, texts, logos). The sketch and description are transmitted to the third-party provider only for the duration of the generation. The number of generations is limited per day and per account.

8. Personal data

Data collected at registration (name, company, email, phone, target show, country, language) is processed by the Publisher to manage the commercial relationship, in accordance with Ivorian Law no. 2013-450 on the protection of personal data. It is kept for 36 months after the last contact, then deleted together with the associated configurations. The User may access, rectify or delete their data by writing to hello@monstand.africa. Saved configurations (10 per account maximum) are purged under the same conditions.

9. Availability and liability

The Configurator is provided “as is”. The Publisher guarantees neither uninterrupted availability nor the accuracy of estimates, which depend on the data entered and the rates in force; only the advisor's firm quote binds the Publisher. The Publisher's liability in connection with the use of the Configurator is limited to direct damages and shall not exceed [TO COMPLETE] XOF.

10. Changes and termination

The Publisher may amend the Terms at any time; the applicable version is the one in force on the day of use (version shown above). The Publisher may suspend or close an account in case of breach.

11. Governing law

The Terms are governed by Ivorian law. Any dispute concerning their interpretation or performance shall, failing amicable settlement, be brought before the competent courts of Abidjan.
